Ternopil Regional Office of the State Property Fund of Ukraine returned a cinema building into the state ownership

The court trials in the case involving a claim by the Regional Office of the State Property Fund of Ukraine in Ternopil region against the "TRK" "CITY CENTER" LLC for the termination of a purchase and sale contract of the non-operating cinema building "Myr" (together with the property) which located at the address: 19, Shevchenko str., Chortkiv town, have been going on for 4 years.

The ground of recourse of the Regional Office to the Court concerning to termination the contractual relationship with the Company was breach of contract by the Buyer - LLC "TRK" CITY CENTER", concerning the reconstruction of the building and the re-equipping the cinema with the latest film technologies, the commissioning of the cinema, maintenance of the privatization object and adjoining territory in the proper sanitary-technical condition.

According to the results of the consideration of the case by the Western Appeal Economic Court adopted a ruling refusing to satisfy the appeal of "TRK" LLC "CITY CENTER" and the Economic Court of the Ternopil region decision from 02.07.2018 was left unchanged which satisfied the Regional Office claims and terminated the purchase and sale Contract.
