Historical review

The State Property Fund of Ukraine is a central executive authority with special status, which is responsible for implementing state policy in the area of privatization, lease, use and alienation of state property, as well as management of state-owned assets, including the state’s corporate rights regarding state-owned entities under its management. It is also responsible for the state regulation of property valuation, property rights, and professional valuation activities.

The Fund’s mission is to increase the investment attractiveness and competitiveness of Ukraine's economy. To achieve this goal, the Fund uses the strategy of transparent and professional management of state property.

Main tasks of the Fund:

  1. Implementation of state policy in the area of privatization, lease, use and alienation of state property, as well as in the area of state regulation of property and property rights valuation, and professional valuation activities.
  2. Organization of the implementation of the Constitution and laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, other legislative acts, and monitoring their execution.
  3. Management of state-owned assets, including the state's corporate rights in the authorized capital of business companies for which privatization decisions and privatization or share placement plans have been approved; companies created during the transformation (including corporatization) of state-owned enterprises under its management; and companies created with the participation of the State Property Fund of Ukraine.
  4. Protection of the property rights of state-owned enterprises, institutions and organizations, as well as the state corporate rights within Ukraine and abroad.
  5. Oversight in the area of organization and conduction of state property privatization, alienation of state property where required by law, lease and use of state property; reversion of state property that was privatized, alienated, or removed from state ownership illegally back to state ownership; and management of the state corporate rights under its management.
  6. State regulation in the area of property and property rights valuation, and professional valuation activities.
  7. Cooperation with international organizations in the implementation of state policy on privatization, lease, use and alienation of state property, as well as the management of the state corporate rights, regulation of property and property rights valuation, as well as professional valuation activities within its delegated authority.

Historical Background

The State Property Fund of Ukraine was established in 1991 by Resolution No. 158 of the Cabinet of Ministers of the Ukrainian SSR to implement state policy in the area of privatization of state property. The first privatization bodies in Ukraine — the Fund, its regional offices, funds, committees, and municipal property management department — were formed in 1992.

In 1994, the President of Ukraine issued a Decree No. 56 "On the Unified System of Privatization Bodies in Ukraine," which essentially created the modern system of privatization bodies.

According to Presidential Decree No. 248/99 of March 13, 1999, "On Changes in the System of Central Executive Bodies of Ukraine," the State Property Fund of Ukraine is included among the central executive bodies.

According to the Law of Ukraine "On the State Property Fund of Ukraine" dated December 9, 2011, No. 4107-VI, the State Property Fund of Ukraine is accountable to the President of Ukraine. The outreach of the Fund is directed and coordinated by the Cabinet of Ministers of Ukraine.
