The State Property Fund requested to the regional state administrations to transfer non-statutory property to their management

In order to solve the social problems of citizens who cannot exercise the right provided by the legislation of Ukraine to privatize housing and to fulfil the instructions of the Prime Minister of Ukraine, the State Property Fund appealed to regional state administrations to transfer functions to manage housing and civil protection premises, which in the process of privatization were not included in the authorized capital of companies.

The position of the State Property Fund regarding the transfer of such property is as follows:

• transfer of housing property in the regional state administration is temporary for the organization of the transfer process to the united territorial communities;

• associations of co-owners of apartment buildings will keep the property of the housing stock;

• according to Article 19 of the Civil Protection Code of Ukraine, regional state administrations are responsible for the fund of civil protection structures;

• civil defense facilities are financially maintained by balance holders - OTG and enterprises;

• OTG and the Road Service will maintain the engineering structures;

• documentation for engineering structures, housing property and civil protection structures should be prepared by OTGs after technical inventory, if necessary.

According to the regulations of Ukraine, the formation and implementation of state policy in the field of housing and communal services and civil protection of citizens is an unusual function for the State Property Fund.

According to the Law of Ukraine “On Local State Administrations”, local state administrations exercise state control in the respective territories, in particular over the preservation of the housing stock and the condition of protective structures of civil defense (civil defense).

The order of the Prime Minister of Ukraine of January 14, 2021 No. 408/1/1-21 sets the task of ensuring the implementation of measures proposed by the State Property Fund to ensure the transfer of housing, protective structures of civil defense, engineering structures, which in the privatization process are not entered the authorized capital of companies, from state privatization bodies to the sphere of management of regional state administrations.
